Medicaid / Long Term Care Planning

Guardianship

There are many reasons to seek a guardianship.  To obtain a guardianship over a person or an estate, the petitioner must ask for court authority.  Our firm will help you in meeting all of the hurdles of bringing a guardianship petition as well as counsel you on the process.  We further help you navigate the annual reporting requirements and maintain compliance with the Guardianship Monitoring Program. Special Needs Trusts 42 USC 1396p d(4)(a)

The Special Needs Trust authorized under 42 USC 1396p d(4)(a) is an extremely specialized trust and should only be drafted by an experienced attorney.  This trust is designed to benefit disabled individuals under the age of 65.  This special trust allows the individual or court to place the disabled individual's assets in trust to supplement their care needs while maintaining their eligibility for state and federal benefits.  While simple in principle, this trust is governed by federal, state and county specific rules.  It is therefore important to select an appropriate drafter of the trust who is familiar with these local rules.  Richard L.
